Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the TMHP website, membership platform and Athlete Support system (together, the "Service"), operated by Toby Maddison, trading as Toby Maddison Human Performance ("TMHP", "we", "us", "our"), a sole trader based in No 4 The Citadel, Mottram Street, Stockport, SK1 3PH United Kingdom.

By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By creating an account, you confirm that you meet this requirement.

3. The Service

TMHP provides:

  • Assessment — an intake process identifying movement limitations, training background, recovery profile and development pathway.

  • Athlete Support — a check-in and scoring system that identifies your current limiting factor across the Five Pillars (Movement, Capacity, Adaptation, Performance, Responsibility) and provides guidance based on that assessment.

  • Membership tiers — Athlete, Performance and Elite, as described on the Membership page, offering varying levels of access, tracking and direct coaching.

The Service provides structured guidance based on the information you provide. It does not replace individualised, in-person coaching unless you are enrolled in Elite Performance Coaching, and it is not a substitute for medical advice (see Section 7).

4. Accounts

You are responsible for maintaining the confidentiality of your login details and for all activity under your account. Notify us immediately at info@tmhp.co if you suspect unauthorised access.

You agree to provide accurate information during Assessment and check-ins. TMHP's recommendations rely on the accuracy of what you submit — inaccurate input (e.g. injury history, fatigue levels) may result in inappropriate guidance.

5. Membership, billing and cancellation

  • Membership fees are billed monthly, in advance, via Stripe.

  • Prices are as shown on the Membership page at the time of purchase and may change with notice to existing members.

  • You may cancel your membership at any time via your account settings; cancellation takes effect at the end of the current billing period.

  • Refunds: memberships can be cancelled at any time within the first 14 days for a complete refund. After the initial 14-day period has elapsed then cancellations will only impact the next billing cycle, and there will be no refund of the active month's payment.

  • We reserve the right to suspend or terminate accounts for non-payment.

6. Intellectual property

The TMHP methodology, including the Five Pillars framework, Athlete Support™ system, scoring logic, and all associated content, graphics and branding, is the intellectual property of Toby Maddison. You may not copy, reproduce, distribute or create derivative works from this content without prior written permission.

You retain ownership of the personal data and content you submit (e.g. check-in responses), subject to our Privacy Notice.

7. Health and safety disclaimer

This is important — please read carefully.

TMHP provides performance coaching and training guidance. It is not a medical service, and nothing in the Service constitutes medical advice, diagnosis or treatment.

  • You should consult a doctor or qualified medical professional before beginning any new training programme, particularly if you have a pre-existing injury, medical condition, or any concern about your fitness to exercise.

  • Physical training carries inherent risk of injury. You participate in any training, movement or exercise guidance provided through the Service entirely at your own risk.

  • Athlete Support recommendations are generated from the information you provide (assessment answers, check-in data) and general coaching principles. They are not a substitute for individualised medical or clinical assessment.

  • If you experience pain, dizziness, chest discomfort or any concerning symptom during training, stop immediately and seek medical attention.

  • TMHP, and Toby Maddison personally, accept no liability for injury, loss or damage arising from your use of guidance provided through the Service, except where such liability cannot be excluded under UK law (see Section 9).

8. Your responsibilities

In line with the Responsibility pillar of the TMHP methodology, you agree to:

  • Provide accurate and honest information

  • Use the Service for personal, non-commercial purposes only

  • Not attempt to reverse-engineer, copy or resell the scoring methodology or platform

  • Exercise your own judgement, and seek professional medical or coaching input where appropriate, rather than relying on the Service as your sole source of guidance

9. Limitation of liability

To the fullest extent permitted by law:

  • TMHP's total liability to you for any claim arising from your use of the Service is limited to the amount you paid for membership in the 12 months preceding the claim.

  • We are not liable for indirect, incidental or consequential losses.

  • Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.

10. Termination

We may suspend or terminate your access to the Service if you breach these Terms, misuse the platform, or provide fraudulent information. You may close your account at any time.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. Material changes will be notified to active members by email.

12. Governing law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
